Comparative Constitutional Law: The South African Experience

This course will examine the importance and utility of comparative constitutional law (constitutional borrowing) in constitutional adjudication. Particular attention will be devoted to constitutional developments in South Africa since its transtion to a constitutional state in 1994. The key documents and decisions which will be examined will be those relating to the protection of civil liberties, economic and social rights, affirmative action and freedom of expression.
