International Human Rights

The course examines both the procedural and the substantive dimensions of the international system of human rights protection. At the procedural level, the course concentrates on the United Nations system, dealing with both Charter-based and treaty-based arrangements. The origins of the system and its development will be examined, however the emphasis will be placed on the current debates about its reform as well as on the role of NGOs and individuals in mobilizing the system. At the substantive level, the students will be confronted with theoretical debates (such as the categories of obligations, the public/private distinction, the notion of collective rights); certain notions relating to the law of treaties and the law of State responsibility which relate specifically to human rights; and contemporary issues which will serve to illustrate these notions (antiterrorist measures, the right to education and the prohibition of child labor, forced disappearances, pluralism in the media for instance).
