Administrative Law in a Supranational Context

This course assumes a basic knowledge of the law and institutions of the European Union. It takes the example of the European administrative law to examine the development of administrative law in a global context. After having considered the main differences between domestic and European administrative law, the course examines six main questions: the role of the "rule of law" in European and domestic law; the different bodies upon which the Union implementing power is conferred, and how they exercise it; the multi-level nature of European administration; how European Commission activity penetrates into the national administrations; whether the authoritative administrative process of the European Union corresponds to those of national administrations; how European law and national law interact, and how this interaction enables citizens and business to choose the law most favorable to them creating a competition between legal systems.
